TSJ Refuses To Cancel Extension Of The Restrictions To Hotel Industry In Castilla y León

The TSJ refuses to cancel the extension of the restrictions to the hotel industry in Castilla y León.

The Superior Court of Justice of Castilla y León has issued an order this morning in which it rejects the request to annul the Board’s agreement that extended the restrictions until September 13.

The TSJ has denied the very precautionary measure requested by the Provincial Association of Hospitality Employers of Valladolid consisting of the suspension of Agreement 76/2021, of July 19, of the Junta de Castilla y León, regarding special public health measures for the containment of Covid-19 throughout the territory of the Community.

Specifically, the suspension requested by the hoteliers has to do with sections 1, 2 and 3 of the aforementioned agreement, regarding the limitations on consumption and capacity inside establishments such as bars, restaurants, discos, gastronomic societies or any other leisure or activity establishment in which some type of service is provided.

The Administrative Litigation Chamber of the TSJCyL, based in Valladolid, orders the matter to be processed in accordance with the provisions of article 131 and following of the Jurisdictional Law, and to hear the Administration so that it alleges what it deems appropriate about the ordinary precautionary measure within one day.

The Chamber considers that there is no specific argument in the submitted application that justifies that now, if the precautionary measure is not immediately adopted without hearing the opposing party, the damages would be irreparable and, therefore, it would be meaningless to adopt a precautionary measure, when the same measures have been in force since Agreement 76/2021, of July 19 “.
